This document sets out the general terms and conditions for using the website www.vittoriasella.com. The website specializes in the sale of leather bags and leather belts.

1. Definitions

For clarity and acceptance of these terms and conditions, the following terms, in both singular and plural forms, have the meanings indicated below:

Owner: Crossbiz S.r.l., with its registered office at Via Giovanni Battista Tiepolo 11, 00196 Rome, VAT number/Fiscal Code 15063071003.
Site: Refers to the website www.vittoriasella.com.
Products: The items provided to the User by the Owner.
User: Any consumer accessing the Site and making purchases of the Products.
Conditions: These terms and conditions govern the relationship between the Owner and the Users, including the sale or supply of the Products offered through the Site.

2. Scope of the Conditions

All sales of Products through the Site are governed by these Conditions. By using the Site or its related services, Users agree to abide by these Conditions along with any other notes, legal notices, or information provided or referenced within. Users who do not agree with these Conditions are not permitted to use the Site. The Conditions applicable to any purchase order or request for Product supply are those in effect at the time of submission. The Owner reserves the right to amend these Conditions periodically, with updates always accessible to Users on the Site. Prior to using the Site, Users are advised to carefully review the Conditions and retain them for future reference. Additionally, the Owner reserves the right to modify the Site's graphic interface, content, organization, and other functional aspects at its discretion, providing Users with necessary guidance when required.

3. Purchase or Supply Requests Through the Site

All Products featured on the Site are meticulously described on their respective product pages, detailing quality, characteristics, availability, price, and any additional charges. It's important to note that these Products are handmade, which may result in natural irregularities or imperfections that are intrinsic to their craftsmanship, rather than defects. Additionally, color variations may occur compared to the images displayed on the Site due to differences in browsers or devices used. These images serve as representations of the Products, and in such cases, the guarantee of conformity (as per Article 8) does not apply.
Purchases through the Site are restricted to Users who are 18 years of age or older. The presentation of Products on the Site constitutes an invitation to offer, with any order placed by the User serving as a contractual purchase proposal or supply request, subject to confirmation and acceptance by the Owner.
Orders are accepted from specific countries only (Austria, Belgium, Bulgaria, Canada, Cyprus, Croatia, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Norway, Netherlands, Poland, Romania, Slovakia, Slovenia, Spain, Sweden, Switzerland, United Kingdom, United States), with delivery restricted to these territories.
The contract of sale or supply is considered finalized upon the Owner's acceptance of the User's proposal. Acceptance may be communicated via an order confirmation sent to the User's provided email address or through the display of an order confirmation webpage.
This confirmation will include comprehensive details such as the order date, User's data, Product specifications, pricing, additional charges, taxes, delivery address, estimated delivery times, associated costs, as well as information regarding the right of withdrawal and warranty.
The sale or supply contract between the parties is not effective until this acceptance occurs. In the event of a Product being unavailable, the Owner will notify the User of revised delivery or supply terms and seek confirmation of the order under the revised conditions. The contract will only be deemed concluded for the Products accepted by the Owner. It is the User's responsibility to verify the accuracy of the data in the order confirmation and promptly inform the Owner of any errors. Additionally, Users are advised to retain copies of the order, confirmation, and these Conditions for future reference.

4. Prices and Payments

Each Product's price, inclusive of applicable VAT, is prominently displayed. Additionally, all relevant taxes, surcharges, and delivery costs will be clearly indicated, as these may vary based on destination, chosen delivery method, and payment method. In cases where these costs cannot be precisely determined in advance, Users will be duly informed of the expenses and the calculation criteria. The Owner reserves the right to adjust Product prices and any associated costs at any time. However, any such alterations will not impact contracts already finalized prior to the change. Users are responsible for paying the Product price in accordance with the specified terms and methods outlined on the Site, while also providing any requisite information.
Accepted payment methods include MasterCard, Visa, American Express, iDeal, Sofort, PayPal, Apple Pay, Google Pay. All transactions conducted on the Site are securely processed using SSL (Secure Socket Layer) encryption technology. Credit card transactions are executed through payment gateways that encrypt data within a secure hosting environment.
It's important to note that the Site utilizes third-party payment processing tools and does not retain access to, nor store, any payment data (such as credit card numbers, cardholder names, passwords, etc.). In the event of payment authorization declines by these third-party tools, the Owner cannot fulfill the Products and shall not be held liable in any capacity.

5. Invoicing

Users wishing to receive an invoice are advised to include a note in their order and provide the necessary billing details. Alternatively, they can email info@vittoriasella.com within 5 days of placing the order, specifying the required billing information. It is important for users to ensure the accuracy of the information provided for invoicing purposes. Any inaccuracies in the provided billing details will be the responsibility of the user, and the owner will not be held liable for any resulting issues.

6. Methods of Product Delivery

Products will be shipped to the address specified by the User, according to the method and timeframe outlined on the Site and confirmed in the order confirmation. Unless otherwise noted, the delivery terms specified in the order confirmation represent the standard delivery duration from the moment the courier assumes responsibility for the delivery. If a Product becomes unavailable, the User will be promptly informed of the revised delivery or supply terms and given the option to confirm the order under the updated conditions. The contract is considered finalized only for the Products that are accepted.
Upon receiving the Product, it is the User's responsibility to verify the accuracy of the order and the integrity of the packaging. In cases of noticeable damage to the packaging and/or the Product, the User has the option to refuse delivery and return it to the courier at no additional cost.
Once the delivery document is signed, the User cannot raise objections regarding the appearance of the delivered Products. The Owner cannot be held liable to any party or third party for damages, losses, or costs resulting from non-performance of the contract due to force majeure events.

7. Right of Withdrawal

The User has the right to withdraw from the purchase or supply contract within 14 days from receiving the Product by sending a written notice to info@vittoriasella.com in the following format:

'I hereby communicate my withdrawal from the sales or supply contract related to the following product:

Order number: _______ Ordered on: _______ Name and Surname: _______ Address: ______ Email associated with the account from which the order was placed: ____________________ Date: ________

If multiple Products are delivered separately under a single order, the 14-day withdrawal period starts from the day of receiving the last Product. Upon exercising the right of withdrawal, the User must return the Product to the Owner without undue delay and no later than 14 days from communicating their decision to withdraw. The User is responsible for covering the direct return shipping costs, unless the Owner explicitly assumes this responsibility, which must be verified and documented accordingly. In the event of the User arranging the return independently, they will receive confirmation of the return address in Italy. Alternatively, if the User entrusts the Owner with the return, the return shipping costs will be deducted from the purchase refund, with the exact cost dependent on package size and pickup location. The Owner will provide information on these costs.
Upon proper withdrawal, the Owner will refund the payments received from the User within 5-10 days of receiving the returned goods and confirming their perfect condition, using the same payment method used for the initial transaction.
Returns and refunds will not be accepted if the Product is damaged, used (except for normal inspection), missing components or accessories, lacking original packaging or labels. In such cases, the Owner will return the Product to the User, who will be responsible for the shipping costs of the new shipment.

8. Product Conformity Warranty

The legal warranty of conformity, as provided by Articles 128-135 of the Consumer Code, is recognized and applicable. The Owner is responsible to the User for any lack of conformity present at the time of delivery and occurring within two years from the delivery date of the Product. The User must report any lack of conformity to the Seller within two months from the discovery date, via written communication to info@vittoriasella.com. In the event of a lack of conformity, the Owner will arrange for repair or replacement of the Product, as chosen by the User. If repair or replacement is impossible or excessively costly, the User may request an appropriate reduction in the price or termination of the contract, with the consequent refund of the amounts paid.
The Owner will promptly address reports of alleged lack of conformity, providing the User with specific procedures to follow based on the Product category and reported defect. It's important to note that this warranty does not cover non-conformities arising from: (i) Damage caused by the User or third parties. (ii) Normal wear and tear of materials or components. (iii) Improper use of the Product.

9. Industrial and Intellectual Property Rights

The Owner asserts ownership, licensing, or the right to use all intellectual property rights related to the Site and its content. Therefore, all trademarks, names, trade names, service marks, word marks, logos, and other signs, as well as illustrations, images, and content on the Site, are and shall remain the property of the Owner or its licensors, protected by applicable intellectual property laws.
These Conditions do not grant the User any license to use the Site or its content unless expressly regulated otherwise. Unauthorized reproduction of explanatory texts and content from the Site will be considered a violation of the Owner’s intellectual and industrial property rights.

10. Site Operation

The Owner endeavors to maintain continuous availability and operation of the Site 24 hours a day. However, the Owner cannot be held responsible if, for any reason, the Site becomes temporarily inaccessible or inoperative at any time or for any duration.
Access to the Site may be suspended without prior notice due to system or internet connection failures, maintenance, repairs, or unforeseen events beyond the Owner’s control.

11. Limitation of Liability

Except in cases of willful misconduct, the Owner shall not be liable to the User for any malfunctions or disruptions related to internet use that are beyond its control or the control of its suppliers. Furthermore, the Owner disclaims responsibility for damages, losses, or costs incurred by the User due to the failure to complete or execute the contract for reasons not attributable to the Owner. The Owner also disclaims any responsibility for fraudulent or illegal use of credit cards and other payment methods by third parties, as it does not have access to the payment data used (e.g., credit card numbers, cardholder names, passwords, etc.). Additionally, the Owner will not be held responsible for: (a) Incorrect or inappropriate use of the Site by Users or third parties. (b) Issuance of incorrect documents or tax data due to User data entry errors, with the User being solely responsible for accurate data entry.

12. Force Majeure

The Owner shall not be held liable for non-performance or delayed performance of its obligations arising from circumstances beyond its reasonable control, including force majeure events or unforeseen and unforeseeable events independent of its will. In the event of force majeure, the Owner's obligations shall be suspended until such events cease. The Owner will undertake all necessary measures to identify solutions enabling the proper fulfillment of its obligations.

13. Links to Third-Party Sites

The Site may contain links to third-party websites or applications. The Owner does not have control over these sites or applications and is not responsible for their content. Certain links may lead to third-party sites or applications offering services through the Site. In such instances, the terms and conditions set forth by these third parties will govern their services, and the Owner assumes no liability for such services.

14. Privacy

The protection and processing of personal data will be conducted in compliance with the Privacy Policy, accessible on the page www.vittoriasella.com/privacy_policy.

15. Applicable Law

For matters not covered in these Conditions, Italian law applies. Any contract between the Owner and the User shall be governed and construed in accordance with Italian laws, particularly the Consumer Code. This provision does not affect the application of more favorable and mandatory regulations provided by the laws of the country where Users have their habitual residence, for those not residing in Italy.

16. Online Dispute Resolution for Users

In the event of disputes related to the sale of Products through the Site:

- If the User resides in the European Union, disputes may be resolved through an extrajudicial procedure without resorting to legal action, using the European Platform for Online Dispute Resolution available at https://webgate.ec.europa.eu/odr/main/?event=main.home.show.

- If the User does not reside in the European Union, disputes may be resolved through an extrajudicial procedure without resorting to legal action, following the regulations available at https://mediazione.infocamere.it/meca/IndexUtenteParte.action.
If parties are unable to resolve the dispute through the extrajudicial procedures mentioned above, the competent court will be determined based on the User’s place of residence.
